These Terms & Conditions (“Terms”) govern purchases made through www.drpruss.swiss and your use of this website.

2. Orders

You must be legally capable of entering into binding contracts and provide accurate information.

All orders are subject to availability and acceptance. We may refuse or cancel an order where reasonably necessary, including because of stock unavailability, pricing or technical error, suspected fraud or misuse, payment failure, export, sanctions or other compliance issues.

3. Products

We make reasonable efforts to describe products accurately. Images, colours, packaging and presentation may vary slightly from the actual product.

Our products are cosmetic products within the meaning of applicable cosmetics legislation. They are intended to be applied to the skin for cleansing, perfuming, protection, maintenance of condition or appearance, and are not medicinal products. Website content is for general information and ecommerce purposes only and does not constitute medical advice.

4. Prices, taxes, duties and payment

Prices are shown in the currency applicable to the selected market. The price shown for the selected market includes applicable taxes, import duties and customs charges for that destination.

Orders are shipped on a delivered duty paid basis for supported destinations. Applicable taxes, import duties and customs charges for those destinations are included in the price shown and paid at checkout.

We offer complimentary standard shipping to all markets served through the website, unless stated otherwise at checkout.

Payment must be made using one of the payment methods offered at checkout. We may use third-party payment providers.

5. Contract formation

Your order is an offer to purchase. We accept your order, and the contract is formed, when we send the order confirmation email.

Before you complete your order, the website will display the main characteristics of the products, the total price, payment method, delivery information, subscription terms where applicable, and applicable return and cancellation information.

6. Delivery

We deliver only to destinations expressly offered in the website’s market selector and checkout at the time of order.

Orders are usually prepared for shipment within 3 working days after order confirmation. Once dispatched, shipments generally arrive within 14 days, but transit times may be longer depending on destination, customs processing, carrier disruption, public holidays, promotions, product launches, force majeure, incorrect address details or other circumstances beyond our reasonable control.

Risk passes to you upon delivery, except where mandatory law provides otherwise.

7. Returns, withdrawal rights and product issues

Our Shipping, Delivery & Returns page forms part of these Terms.

We offer a voluntary return window of 14 days from delivery for eligible products.

To request a return, you must contact us within 14 days after delivery and follow our return instructions. We may refuse returns sent without prior authorization, except where refusal would be prohibited by applicable law.

Because our products are cosmetics, change-of-mind returns are accepted only where the product is unopened, unused, in its original packaging and any protective or hygiene seal remains intact. If a sealed product has been unsealed after delivery, it cannot be returned for health protection and hygiene reasons, unless it is defective, damaged, incorrect, non-conforming or return is otherwise required by applicable law.

If you are a consumer in the EU, EEA or UK, you generally have a statutory right to withdraw from your online purchase within 14 days from delivery, subject to applicable legal exceptions, including sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed after delivery.

If you validly exercise a statutory withdrawal right, you must return the goods within 14 days after telling us that you wish to withdraw, unless we have offered to collect them or applicable law provides otherwise.

For Switzerland and other destinations where no mandatory statutory withdrawal right applies, returns are accepted only in accordance with our published return policy.

Nothing in these Terms limits or excludes statutory rights relating to defective, damaged, non-conforming or incorrectly supplied products. Statutory warranty rights remain unaffected.

8. Subscriptions

If you purchase on a subscription basis:

·         you authorize us to charge the recurring amount to your selected payment method at the selected interval until cancellation;

·         subscriptions are delivered every 2 months;

·         the subscription price, delivery and billing frequency, and cancellation method will be shown before purchase;

·         billing occurs automatically on your scheduled renewal date, shortly before your next shipment;

·         the billing date will be every two months after your initial purchase. The deadline for cancelling, skipping or changing the next shipment will be 2 days before the next billing date;

·         subscriptions continue until cancelled by you or by us;

·         you may manage your subscription through your online account or by contacting customer service at drpruss@drpruss.com;

·         subject to the functionality offered on the website, you may cancel, change or skip the next scheduled shipment before the applicable deadline shown before purchase and in your subscription account;

·         if a request is submitted after billing for the next cycle has been processed, the change will apply from the following cycle, unless required otherwise by applicable law;

·         we may send service communications about upcoming subscription orders, billing, failed payments, product availability or changes affecting your subscription;

·         if a payment attempt fails, we may retry payment, request updated payment details, skip the shipment, suspend the subscription or cancel it;

·         we may make reasonable changes to subscription pricing, shipment dates or product availability and will notify you in advance where required by law.

9. Promotions

Promotional codes, gifts, samples and other offers are subject to availability and any specific terms published with the offer.

Unless expressly stated otherwise:

·         promotions cannot be combined;

·         promotions cannot be exchanged for cash;

·         promotions cannot be applied retrospectively;

·         where a qualifying order is returned, associated gifts, samples or promotional items may also need to be returned, or their value may be deducted from the refund, where permitted by law.

Where legally required, price reductions will be shown by reference to the applicable prior price.

We may modify, suspend or withdraw a promotion where reasonably necessary.

10. Reviews

If you submit a review or other content, you confirm that it is accurate, genuinely reflects your experience, and does not infringe third-party rights or contain unlawful, misleading, abusive, discriminatory, offensive, spam or advertising content.

We may moderate, reject, remove or not publish reviews where reasonably necessary, including where they are fake, irrelevant, unlawful, abusive, misleading or inconsistent with these Terms.

Where reviews are marked “verified”, this means we have taken reasonable steps to confirm that the review relates to a purchase made through our website. If reviews are sponsored or incentivised, this will be disclosed.

By submitting a review or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display that content for ecommerce, marketing, customer-service and brand purposes, subject to applicable law.

11. Website use and intellectual property

You may use this website only for lawful personal, non-commercial purposes. You must not misuse the website, interfere with its operation, circumvent security features, scrape or copy content unlawfully, or use the website in a way that could damage us or other users.

All website content, including text, images, graphics, videos, product descriptions, logos, trademarks, design, layout and software, is owned by or licensed to DR PRUSS and is protected by applicable intellectual property laws.

No website content may be copied, reproduced, republished, uploaded, transmitted, distributed, modified or used for commercial purposes without our prior written consent.

The website may contain links to third-party websites or services. We are not responsible for their content, availability, policies or practices.

12. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Subject to that, we are not liable for indirect, incidental or consequential losses, or for loss of profit, business or opportunity arising from your purchase, use of products or use of the website, except where such limitation is prohibited by law.

13. Changes

We may update these Terms from time to time. The latest version will always be published on this website with the updated date. Changes do not affect orders already accepted unless required by applicable law.

14. Governing law and disputes

These Terms are governed by the laws of Switzerland, excluding its conflict-of-law rules and the CISG.

If you are a consumer, this choice of law does not deprive you of mandatory protections available under the laws of your country of residence. If you are a consumer resident in the EU, EEA or UK, you may also bring proceedings in the courts of your country of residence where mandatory law gives you that right.

Any dispute shall be submitted to the competent courts of Lausanne, Switzerland, unless mandatory law provides otherwise.
